These Terms & Conditions (Terms) apply to your use of the Yarram Koala Sanctuary Ltd website, including browsing, creating an account, making donations, purchasing goods or services, booking activities, or otherwise interacting with us online.

By using this website, you agree to these Terms.

2. About Yarram Koala Sanctuary Ltd

Yarram Koala Sanctuary Ltd is an Australian company limited by guarantee. It operates on a not-for-profit basis. Revenue generated through the website, including donations, merchandise sales, bookings, memberships, sponsorships and other activities, is reinvested into the company’s charitable, conservation, animal welfare, education and community purposes and is not distributed to members.

3. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights, guarantees, remedies or protections you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

Under the Australian Consumer Law, consumers have automatic guarantees when buying goods or services. If those guarantees are not met, consumers may be entitled to a repair, replacement, refund, cancellation or compensation depending on the nature of the problem.

4. Website Use

You agree not to use this website in a way that:

  • breaches any law;
  • interferes with website security or operation;
  • uploads viruses, malware or harmful code;
  • infringes intellectual property rights;
  • is abusive, defamatory, misleading, obscene or discriminatory;

  • misuses donation, booking, contact or account systems.

5. Accounts and User Content

Where user accounts, comments, reviews, uploads or submissions are available, you are responsible for the accuracy and legality of anything you submit.

You grant Yarram Koala Sanctuary Ltd a non-exclusive licence to use, display, reproduce and moderate user-generated content for website, operational and promotional purposes, unless otherwise agreed.

We may remove user content that we consider inappropriate, unlawful, misleading, offensive, irrelevant or harmful.

6. Intellectual Property

Unless otherwise stated, all website content, including text, images, logos, graphics, design, video, audio, documents, trademarks, patents, and branding, is owned by, protected by copyright, or licensed to Yarram Koala Sanctuary Ltd.

You may view and download website content for personal, non-commercial use only. You must not copy, reproduce, modify, publish, distribute, sell, licence or commercially exploit website content without written permission. If you receive permission, you must use this content in accordance with our Brand Guidelines.

7. Donations

Donations are voluntary contributions to support the purposes of Yarram Koala Sanctuary Ltd.

Unless otherwise stated, donations do not create a right to receive goods, services or influence over the company’s operations.

Donation refunds may be considered where a donation was made in error, duplicated, processed incorrectly, or where required by law. Requests should be made promptly by emailing koala@yarram.org.au.

8. E-commerce and Sales

We may sell merchandise, memberships, event tickets, experiences, educational materials, sponsorship packages or other products and services through the website.

All prices are in Australian Dollars (AUD). Prices are inclusive of GST unless stated otherwise.

Accepted payment methods may include credit card, debit card, online payment gateway, direct deposit or other methods shown at checkout.

We may refuse or cancel an order where:

  • an item is unavailable;
  • there is a pricing or description error;
  • payment is not authorised;
  • delivery details are incomplete or invalid;
  • we reasonably suspect fraud, misuse or breach of these Terms.

9. Contract Formation

You must be at least 18 years of age in order to execute legally binding contracts.

Placing an order and making payment does not automatically mean we have accepted your order.

A legally binding contract of sale is formed when we send you an order confirmation email confirming acceptance of your order.

An automated payment receipt or order acknowledgement may not, by itself, constitute acceptance unless it clearly states that the order has been accepted.

10. Delivery and Shipping

Estimated delivery timeframes will be shown at checkout or otherwise notified. Delivery times are estimates only and may be affected by postal delays, courier issues, weather, public holidays or events beyond our control.

Risk in goods passes to you on delivery. If goods are lost or damaged in transit, contact us at koala@yarram.org.au as soon as possible with your order number, photos if relevant, and delivery details.

11. Refunds, Returns and Consumer Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

If a product or service has a minor problem, we may offer a repair, replacement, resupply or other appropriate remedy.

If a product or service has a major failure, you are entitled to choose a refund, replacement, cancellation or other remedy available under the Australian Consumer Law. Australian Competition and Consumer Commission (ACCC) guidance explains that remedies depend on whether the problem is minor or major, and may include repair, replacement, refund, cancellation and compensation where loss is suffered.

A major failure may include where a product or service:

  • is unsafe;
  • is substantially unfit for its normal purpose;
  • is significantly different from its description or sample;
  • would not have been purchased by a reasonable consumer who knew about the problem;
  • cannot be fixed within a reasonable time.

Change-of-mind returns are not automatically available unless we expressly offer them. Where we do offer change-of-mind returns, conditions may apply, such as proof of purchase, unused condition, original packaging and return within a specified period.

To request a remedy, email koala@yarram.org.au with your order number, description of the issue and supporting photos or documents.

12. Events, Bookings and Experiences

Where we offer events, tours, talks, education programs, sanctuary visits or experiences, specific booking terms may apply.

We may cancel, postpone or reschedule activities due to animal welfare requirements, weather, safety issues, staff availability, regulatory requirements or circumstances beyond our control. Where this occurs, we will offer a reasonable remedy, which may include rescheduling, credit or refund, subject to the Australian Consumer Law.

13. Third-Party Links

This website may contain links to third-party websites, platforms, payment processors, social media pages or external resources that we think may interest you.

We are not responsible for third-party content, availability, security, privacy practices, accuracy or conduct. Accessing third-party links is at your own risk.

14. Website Availability and Information

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted access or error-free operation.

Website information is general in nature and may change without notice. Conservation, animal care, project, event and facility information may be updated as circumstances change.

To the extent permitted by law, we are not liable for loss arising from website downtime, technical issues, reliance on general information, third-party links, or misuse of website content.

15. Limitation of Liability

To the maximum extent permitted by law, Yarram Koala Sanctuary Ltd is not liable for indirect, incidental, special or consequential loss, loss of profits, loss of data, loss of goodwill, or business interruption arising from use of the website.

Where liability cannot be excluded, our liability is limited, where permitted by law, to supplying the goods or services again, repairing or replacing goods, or paying the cost of doing so.

This clause does not limit rights that cannot be excluded under the Australian Consumer Law.

All reasonable endeavours have been used to ensure that the content of this website is accurate. However, to the maximum extent permitted by law, Yarram Koala Sanctuary Ltd does not warrant that the site in its entirety including its content, submission comments, or user contributions contain accurate information or will be free from bugs, defects or errors, or accessible without interruption, nor is any liability accepted by the Yarram Koala Sanctuary Ltd for any loss or damage arising from the use of this site.

18. Commissions

We do not deal with individuals who wish to be paid for services, support, or other activities unless we intentionally enter a legally binding contract to do so. For example, we do not pay commissions or other sums to anyone who helps arrange a grant, fulfill a job or anything else unless we have expressly contracted to do so in writing prior to any such arrangement.

19. Complaints and Dispute Resolution

If you have a concern, please contact us first.

Step 1: Email koala@yarram.org.au with your name, contact details, order or booking number if relevant, and a clear description of the issue.

Step 2: We will acknowledge your complaint within a reasonable time and may request further information.

Step 3: We will review the issue and provide a proposed response or remedy.

Step 4: If the matter is not resolved, it may be escalated to a senior representative of Yarram Koala Sanctuary Ltd.

Step 5: If still unresolved, either party may seek assistance from Consumer Affairs Victoria, another relevant regulator, mediation, or a court or tribunal with jurisdiction.

20. Governing Law

These Terms are governed by the laws of Victoria, Australia.

You agree that the courts and tribunals of Victoria have jurisdiction, subject to any rights you may have under applicable consumer protection laws.

21. Changes to these Terms

We may update these Terms from time to time. The current version will be published on this website with the updated date.

Continued use of the website after changes are published means you accept the updated Terms.
